2002 Hyundai Elantra - Passed Check, Check Engine Light Back On, Can I Sell?
Hi! My Hyundai passed a smog test in October. However, about a week later, the CEL came back on. I would like to sell the car as-is, and get whatever I can for it. I have the smog certificate that's less than 90 days old. Will the new buyer have to have the car smogged again upon purchase, and then fail because of the CEL? Or does he have two years from my Smog check to get it done, giving him time to get the repairs taken care of? I plan on being completely honest with any potential buyer. I just want to know what they are legally required to do once they buy the car. If they're required to get it smogged right away, I'll probably just donate the car to charity. Thank you!

Your honesty is commendable. As far as California law is concerned, a smog check certificate is valid for 60 days, when being used for title transfer purposes. So, in fact, if you were sell your Hyundai Elantra now (and assuming the buyer would immediately transferred title) the DMV would not require a new smog certificate and the he/she would not need a smog check for 2 years.
