Buying a Honda Accord with Tampered Smog Part

I'm buying a used 1992 Honda Accord but just found out that during the car's last smog test it failed due to an emission device found to be tampered with. My question is, does the owner have to pay for the smog test before I purchase it or do I pay for it? And will it cost more. Thank you.


Answer:

24007 (b)(2) of the Vehicle Code states it is the responsibility of the seller to provide a valid smog certificate at the time of delivery of the vehicle. We do not recommend buying a vehicle which will not pass the smog test, as it can cost hundreds of dollars to bring the vehicle into smog check compliance. Ask the seller to smog check this Honda Accord, prior to you purchasing it.
