Does the smog check have the legal right to access my car's computer system?

I'm wondering what law gives the state of California the right to access my vehicle's computer system and data.

Vehicle code section 4000.1 is the California law which requires smog inspection for California vehicles, and Section 3340.45 Title 16 of the California Code of Regulations is the instruction on the smog check procedure including the administration of OBD II Functional Test.
