Is my 1997 Ford Explorer eligible for California's vehicle buy back program?

We have applied for the CAP buy back program. My Ford Explorer has the "death" rattle. When I read the requirements it states the you can apply if it fails the smog check, which ours didn't, OR if it passed the smog test, as long as it has been registered for 2 years, etc. (Page 4 of the application on line). Is that correct? I have been trying to contact them as it has been 3 weeks but the phone system keeps giving me a "technical difficulties" answer when I go through the phone tree. Any assistance would be great, not sure where to look or who to turn to.
Answer:

You can apply for the CAP Buy Back Program at any time, and for any reason; so long as your vehicle has not had a lapse in registration. No official word has been given, but CAP may have run out of funds for 2011. Thier phone system may be busy due to the high number of callers trying to get an answer back on thier applications.
