2000 Dodge Neon failed smog check before being totaled

I just purchased a 2000 Dodge Neon which failed the smog check. Before getting a chance to get a smog check retest I got into a huge accident and totaled the car.

My insurance cannot write me a check for my car until the title is transferred into my name. I brought all the paperwork and still they say it doesn't meet the requirements because it needs to be smogged. Well how can I smog a car that's totaled? I've called the congressman, state senate office, assembly member all have called dmv headquarters to help, but I am at the end of my rope it's been two weeks and I live paycheck to paycheck, do you know anyone who could help me on what my options are?


Answer:

Have you considered transferring the title to your name as a non-operational vehicle? Non-operational vehicle's do not need smog inspections and can not be driven on public roadways. Worst case scenario you can register the vehicle under "dismantle only" status.
