Who Pays for Smog Check When Buying From Used Car Dealer?
Do I have to pay for emissions testing when buying a car from a used car dealer. I know I don't have to with a private party, yet the dealership listings almost always include emissions test fees. Thanks in advance.
Answer:
The law only requires the seller of a used vehicle (whether dealership or private party) provide the buyer with a passing smog check certificate. Who pays for the smog check cost is a matter to be decided between the seller and buyer. Used car dealers rarely absorb the smog test cost. Instead they pass it on to the buyer and indicate such on the buyer's invoice. A private party can do the same thing if they choose, though rarely do.
