Who is Responsible to Smog Test an Out of State Vehicle?

I bought a car in California but it has out of state license plates. Who's responsible to have it smog checked, the buyer or seller?

Answer:

Assuming this transaction occured in California and sales taxes are due to California, the sale is governed by California law; which requires the seller of the vehicle to obtain a valid smog certificate prior to turning over the vehicle to the buyer. Verify this information with the CA DMV by calling (800) 777-0133 for latest/current smog requirement laws and regulations.
