1997 Jeep - Grand Cherokee Laredo. My question is: Does a vehicle need to be owned for a particular period of time to get approved for CAP repairs? The DMV is requiring a passing smog test pass in order to get my registration tags for my Jeep.
I am a low-income citizen, that just lost his job a few weeks ago. I have been in group housing for four months (which has been free through parole classes), but this ended on the 1st of this month and I am now homeless. I just recently bought this Jeep with my savings from most of my last job's income. I am now very near to being broke. Do I qualify for the CAP Program or do I need to have owned the vehicle for any certain length of time before the CAP Program applies to me? Thanks for your time... Sage. Answer:
Sorry to hear of your situation. Unfortunately the Consumer Assistance Repair program is not available for vehicle's undergoing a title transfer. We should point however, Section 24007 (b)(2) of the Vehicle Code states it is the responsibility of the seller to provide a valid smog certificate at the time of delivery of the vehicle. Therefore, per California law, the seller is responsible for making sure to provide you a passing smog certificate when selling their vehicle; even if a vehicle is bought as-is. The law does not recognize "as-is" where it applies to the smog check. Please note, this is not legal advise, simply an overlook on the matter from our experience.
